Utah's Lawyer In Marriage Case Cites Religious Duty In Defending Amendment

WASHINGTON — The lead outside attorney for the state of Utah told his former law firm he was leaving to fulfill "a religious and family duty" to defend "the constitutionality of traditional marriage."

The departure email that Gene Schaerr sent to his Winston & Strawn colleagues on Jan. 17, published Wednesday by Above the Law, made clear that he was leaving the firm to assist the Utah Attorney General's Office in defending the state's ban on same-sex couples marrying because his own personal belief aligned with the state's position.

In the email, sent the morning after Utah Attorney General Sean Reyes announced his appointment as the lead outside lawyer helping the state to defend the state's 2004 amendment banning same-sex couples from marrying, Schaerr wrote:

When Schaerr's appointment was announced, Reyes' office noted that Schaerr was from Utah and got his undergraduate degree from Brigham Young University.

"It's quite alarming that the reason for him taking this position has nothing to do with the U.S. Constitution or the legal issues at play. His entire motivation for taking the position is to impose a certain religious viewpoint on all Utahns — and that's wrong," Human Rights Campaign vice president Fred Sainz told BuzzFeed. "When you become an attorney, you take an oath to uphold the U.S. Constitution, not any particular religious doctrine."

Schaerr is one of three outside attorneys hired by Reyes' office to assist at the 10th Circuit Court of Appeals and, potentially, the Supreme Court in its defense of the marriage amendment, Amendment 3. A federal trial judge struck down the amendment on Dec. 20, 2013, and more than 1,300 same-sex couples married before the Supreme Court stopped the judge's ruling from being in effect during the state's appeal.

HRC had taken an aggressive position back in 2011 against the decision by another law firm, King & Spalding, to help the House in its defense of the Defense of Marriage Act — a defense that it ended days later, leaving Paul Clement to join another, smaller firm to continue the defense.

Sainz pointed to Schaerr's decision to leave Winston & Strawn before taking on the case as a sign of victory, stating, "I definitely think it's a measure of our success as a movement that no serious law firm was willing to take this case. ... It's clear that Winston & Strawn made a reputational decision that taking this case was not in their best interests."

Of Schaerr's stated reasons for taking the case, though, others echoed Sainz in pushing back.

"At least it's clear what really is the underlying motivation of defending the discrimination," Freedom to Marry president Evan Wolfson said of the email. Of the religious grounding of Schaerr's comments, Wolfson added, "That's understandable given that the discrimination is really motivated by those kinds of attitudes."

Neither Schaerr nor lawyers for the plaintiffs in the Utah marriage case responded to requests for comment.

Election Commission: Kids Should Stay Away From Schools Being Used As Polling Places On Election Day

WASHINGTON — The commission President Obama launched after millions of voters stood in long lines on Election Day 2012 said Wednesday that one way to solve the polling place bottleneck problem is to use more schools as polling places. But, citing the potential for school shootings, the commission found that means more schools will have to be closed.

The Presidential Commission on Election Administration, a blue-ribbon panel Obama first promised in his election night victory speech in November 2012, recommended more early voting options and simpler voter registration systems to avoid the snaking lines and confusion that marked Election Day 2012. The panel also recommended states open up more schools as polling places, noting that schools are election administrators' "preferred venue" for voting due to the facilities on hand and low cost when it comes to hosting voters.

School leaders have been shying away from serving as polling since the Newtown shooting, with administrators worried that opening the doors to voters poses a security risk.

"Since the tragic events in Newtown, Conn., some states have considered imposing additional limitations on access to schools for voting," the commission's report states. "It is this concern — security — that has presented the largest obstacle to widespread use of schools."

The solution proposed by the presidential commission: Close the schools to students when voters are there. From the commission's findings:

State legislators working with school boards and election officials should be able to craft legislatively authorized programs that effectively balance school and electoral administrative needs. The Commission strongly recommends that all states review their state laws and contemporary practices within their jurisdictions to ensure the continued and future use of schools as polling places. The Commission more specifically recommends close attention to the use of professional or in-service training days to enable voting to take place on days when students would not be on location in school.

Anti-Hillary Group Calls For Investigation Into Super PAC's Email List Rental

A super PAC aimed at stopping Hillary Clinton from becoming president filed a complaint with the Federal Election Committee on Wednesday against the former secretary of state and Ready for Hillary, another outside group.

Stop Hillary PAC, a group founded last summer by a team of Republican operatives, alleged in the complaint that Clinton's 2008 presidential campaign violated campaign finance law by renting its list of email addresses to Ready for Hillary.

The complaint, filed with the FEC on Wednesday afternoon, requests an "investigation into whether Clinton's authorization of the use of her list by Ready for Hillary PAC constitutes violations of federal campaign finance laws."

Ready for Hillary used the Clinton 2008 list to send an email to supporters earlier this month offering free bumper stickers. PAC spokesman Seth Bringman told Time magazine then that the group sought the list "to connect with her past supporters."

Campaign finance regulation prohibits coordination between candidates and political action committees. Clinton, of course, is not a declared candidate. Dozens of entities have rented the 2008 campaign list, including the Clinton Foundation and EMILY's List, the group dedicated to electing pro-choice women to public office.

But the anti-Clinton PAC argues in the complaint that, in authorizing the rental to Ready for Hillary, Clinton is "openly encouraging and supporting the activity" of the group — an authorization, they say, that makes Clinton a candidate "by operation of law," and therefore subjects her to campaign finance regulation.

Bringman, the spokesman for Ready for Hillary, dismissed the complaint. "They're looking for something to do, I guess," he said of Stop Hillary. "But we're focused on our nearly 2 million grassroots supporters who are ready to support Hillary Clinton should she decide to run for president."

Stop Hillary's central allegation hinges on what they characterize as Clinton's "authorization" of Ready for Hillary. A candidate, the group says, may not designate a political action committee as an authorized committee when that PAC supports more than one candidate. Ready for Hillary does focus on Clinton, but also other candidates she supports, like Virginia Gov. Terry McAuliffe.

Dan Backer, Stop Hillary's lawyer, said the list rental "of course" indicates an authorization of Ready for Hillary. "What else could it be?" he said. "That violates federal election law, and we're calling on the FEC to swiftly investigate."

Any individual or group may file a complaint with the FEC.

Backer said he expects the FEC review process to take several months.

A representative for Hillary Clinton did not respond to a request to comment.

AP Photographer Admits Syrian War Picture Was Photoshopped

The Pulitzer Prize-winning photographer said he manipulated a photo of a Syrian rebel by “cloning” other pieces of the background to cover a colleague’s camera.

The Associated Press said Wednesday one of its photographers admitted to altering a photo taken last year during the war in Syria and pulled all of his images from its wires.

According to the news agency, Narciso Contreras recently told editors he had manipulated a photo of a Syrian rebel by "cloning" other pieces of the background and pasting them over a colleague's camera in the frame before sending it to an AP photo desk.

While the AP does allow photographers to use software to lighten or darken photos, only "minor adjustments in Photoshop are acceptable," its ethics policy states.

The freelance photographer, who shared a Pulitzer Prize for his images of the war, said the photo was the only one he had manipulated.

"I took the wrong decision when I removed the camera ... I feel ashamed about that," Contreras said. "You can go through my archives and you can find that this is a single case that happened probably at one very stressed moment, at one very difficult situation, but yeah, it happened to me, so I have to assume the consequences."

The AP said it severed ties with the photographer after learning of the manipulation and reexamined 494 other photos shot by Contreras but did not find any other alterations.

"AP's reputation is paramount and we react decisively and vigorously when it is tarnished by actions in violation of our ethics code," said Vice President and Director of Photography Santiago Lyon. "Deliberately removing elements from our photographs is completely unacceptable and we have severed all relations with the freelance photographer in question. He will not work for the AP again in any capacity."

The news agency previously pulled a series of photos in 2011 after a photographer was caught altering an image to remove his shadow.

The teacher — now an assistant principal — has since resigned from California’s Alhambra High School. Update: Another woman has claimed she was molested by the same teacher.

On Friday, YouTube user "Jamie X" uploaded a video of herself calling a former teacher, who Jamie said sexually abused her from age 12 to 20.

"I am 28 years old and have been waiting years to get up enough courage to report a teacher for sexually abusing me for years," Jamie wrote in the video description. "When I finally got up enough courage to report her, I found out that the statute of limitations was up and she will never have to pay for the things that she did to me."

The call between Jamie and Andrea Cardosa begins about two minutes into the video:

Jamie: Is this Ms. Cardosa?
Cardosa: Yes.
Jamie: The Ms. Cardosa that used to work in Moreno Valley?
Cardosa: Well, it depends on what part of Moreno Valley. What, you know, yes.
Jamie: Is it Val Verde school district?
Cardosa: Yes.
Jamie: Used to work at Chemawa?
Cardosa: In Riverside, yes.
Jamie: OK. This is Jamie. You're an assistant principal, huh?
Cardosa: Yes.
Jamie: So what happens when a student comes in and says that they're having a sexual relationship with a teacher?
Cardosa: Then I would involve law enforcement.
Jamie: So how is that any different from what you did when I was at Chemawa Middle?
Cardosa: It's not.
Jamie: So why are you excluded from the law? Why did you do that? I was only 12 years old when I met you. You realize you brainwashed me and you manipulated me? And that what you did was wrong?
Cardosa: Yes. And I regret it.
Jamie: You know that I am completely messed up? That I have so many issues because of you?
Cardosa: I only — I just wanted to help you.
Jamie: How is having a sexual relationship with a 12-year-old student helping?
Cardosa: That wasn't anything that I intended. I don't even know what happened.
Jamie: It's completely shocking to me that you are an assistant principal. Are you doing this with other students too?
Cardosa: No.
Jamie: Is that how you help them?
Cardosa: No. Not at all.
Jamie: You ruined my life. You ruined my childhood. You realize that?
Cardosa: No. No.
Jamie: You sicken me. You sicken me. Every day when I think about what you did you sicken me. I have kids of my own and I'm the age now that I pretty much met you at, and I could never think about doing the things that you did. You should be so ashamed and so disgusted with yourself.
Cardosa: I am. I am.
Jamie: How fucking dare you.
Cardosa: I regret it every day. Every day.
Jamie: You're disgusting. Bye.

Jamie, later identified as Jamie Carrillo, told KTLA she posted the video to let parents know about the assistant principal's predatory past.

Cardosa has since resigned and her case referred to police, according to a letter sent out by her school district. In a pre-recorded message to parents on Sunday, Alhambra High School said no current students have come forward with allegations against Cardosa.

"Based on the Alhambra Police Department's preliminary investigation, no Alhambra High School students were identified, nor have any Alhambra High School students come forward. The alleged action took place in another school district."

UPDATE —Jan. 22, 2014 8:00 p.m. ET: Another young woman, who did not wish to be identified, has come forward to claim that she was also abused by Cardosa, CBS Los Angeles reported.

In an interview with CBS Los Angeles, the woman alleged that she was "scared" to talk about things before Jamie's YouTube video surfaced.

The woman said, "Our stories are exactly, extremely, extremely alike."
She said that now that she was older and more mature she "sees what was going on" when she was a child.

The woman also said that after watching the video there "was no doubt" that the teacher who Jamie accused of sexual abuse, is the same one who the woman claims abused her. "I saw myself in Jamie. I saw myself as if I was talking to her," she told CBS Los Angeles.

The woman's lawyer said that his client was a victim and the police should investigate her claims.

Illinois Lawmaker Wants To Broaden Religious Exemptions In Marriage Equality Law

A Republican state representative in Illinois introduced legislation Wednesday that would amend the state's new marriage equality law to broaden religious exemptions.

Rep. Josh Harms, a freshman lawmaker from Watseka, Ill., introduced House Bill 4263, which would expand religious facilities the state would consider as exempt from solemnizing or hosting marriages for same-sex couples under the law, which takes effect this June.

Marriage equality supporters in the state say the language Harms is proposing is too vague and question the representative's intentions, seeing as the bill would face a House controlled by Democrats and because he is up for reelection later this year.

"I just want to know -- the biggest thing is -- what is the intent here?" said Anthony Martinez, executive director of The Civil Rights Agenda.

Specifically, the bill would add "places of worship" and religious schools to the list of religious facilities exempted under the law, which already includes sanctuaries, parish halls and fellowship halls. But Martinez is concerned the phrase "places of worship" could potentially be applied to a number of things, he said.

Bernard Cherkasov, CEO of Equality Illinois, said he does not expect the measure to gain traction. Both chambers are controlled by Democratic majorities who just approved the marriage equality law last November.

However, the legislation and another bill introduced Tuesday to outright repeal marriage equality, "demonstrate that marriage opponents are not giving up and they're not closing up shop in Illinois," Cherkasov said.

Peter Breen, vice president and senior counsel at conservative legal group the Thomas More Society, which opposed marriage equality legislation, said he and his organization welcome additional exemptions for religious organizations -- though it's too early in the legislature's filing period to back Harms' bill, he told BuzzFeed.

Earlier this week, Jim Walder, the owner of a bed and breakfast in central Illinois said his business won't host weddings for same-sex couples when the law takes affect because of his Christian religious beliefs on marriage, a violation of the state's Human Rights Act. He already faces a complaint pending before the Illinois Human Rights Commission for refusing to host civil union ceremonies at his venue.

"With regards to the bed and breakfast, the couple believes truly that they have a moral obligation to deny same-gender couples who want to be married there," Martinez said. "And so with a deep religious belief such as that, does that mean that if they pray three times a day in their bed and breakfast that it's now a place of worship?"

The introduction of the bill comes just a day after Sen. Kyle McCarter, a Republican, introduced legislation that would repeal the marriage equality law outright. Martinez said McCarter's move, too, was motivated by politics in an election year.

Harms voted "no" when the House passed the marriage equality bill, the Religious Freedom and Marriage Fairness Act, in a 61-54 vote last November. Gov. Pat Quinn signed the bill into law Nov. 20.

Messages were left at Harms' district and capitol offices seeking comment.
