New York Times Reporter Won't Be Called To Testify In Years-Long Leak Case

The Justice Department had been pushing James Risen to reveal the confidential sources he used for his 2006 book on the Bush administration, State of War. But on Monday, the New York Times reported that prosecutors withdrew the subpoena.

The Justice Department has been trying to get Risen to reveal his confidential sources since 2008, when prosecutors first subpoenaed him to testify in the case against Jeffery Sterling. A former C.I.A. officer, Sterling was charged with passing classified information to Risen.

After President Obama won election, Attorney General Eric Holder continued the case, and tried to compel Risen to testify again in 2011.

Risen has steadfastly refused to reveal the identity of his sources, acknowledging in court only that there were several.

In recent months, however, there were signs that Risen would likely avoid jail time for refusing to comply with the subpoena.

Speaking at a forum in Washington D.C. in October, Holder said a resolution "that will be satisfactory to everybody" was in the works. On Monday, the Times reported that prosecutors had withdrawn the subpoena.

In a statement carried by The Times, executive editor Dean Baquet said he was pleased with the outcome.

"I'm glad the government realizes that Jim Risen was an aggressive reporter doing his job and that he should not be forced to reveal his source," Baquet said.

South Dakota Same-Sex Marriage Ban Unconstitutional, Federal Judge Rules

The ruling is on holding pending any appeal from the state.

WASHINGTON — A federal judge in South Dakota added her voice to the chorus of judges ruling over the past 13 months that bans on same-sex couples' marriages violate the Constitution.

"Plaintiffs have a fundamental right to marry. South Dakota law deprives them of that right solely because they are same-sex couples and without sufficient justification," U.S. District Court Judge Karen Schreier wrote on Monday.

The ruling is stayed, or on hold, pending any appeal from the state. "Because this case presents substantial and novel legal questions, and because there is a substantial public interest in uniformity and stability of the law, this court stays its judgment pending appeal," she wrote in the judgment for the case.

In a statement, South Dakota Attorney General Marty Jackley suggested that an appeal is forthcoming, saying, "It remains the State's position that the institution of marriage should be defined by the voters of South Dakota and not the federal courts. Because this case presents substantial legal questions and substantial public interest the Federal Court has stayed its judgment allowing South Dakota law to remain in effect pending the appeal."

Lawyers for the same-sex couples challenging the ban, however, told BuzzFeed News that they also will challenge the stay should South Dakota officials appeal the ruling.

"The Supreme Court and federal appellate courts have not been kind to these stays in recent months," lawyer Joshua Newville said. Because of the fact that other decisions have not been stayed pending appeal, National Center for Lesbian Rights lawyer Shannon Minter added, "It seems unfair that couples in South Dakota would have to wait."

In deciding whether the state's ban violates a fundamental right — here, the right to marry — Schreier rejected "defendants' argument that the court should limit the fundamental right to marriage based on the traditional understanding of that right," in other words, limited only to opposite-sex couples, instead concluding that such a view "is contrary to Supreme Court precedent."

As to whether the ban violates equal protection guarantees, Schreier found that the infringement of a fundamental right in connection with a claimed equal protection violation effectively controlled the question and meant that the ban violated equal protection as well.

"For reasons stated with respect to plaintiffs' due process claim, South Dakota's same-sex marriage ban deprives same-sex citizens of a fundamental right, and that classification is not narrowly tailored to serve a compelling state interest," Shreier wrote, in finding that equal protection guarantees were violated as well.

Schreier was nominated to the federal bench by President Bill Clinton in 1999.

Diane Von Furstenberg Fuels IPO Speculation

The brand is figuring out how to translate itself into the future. Whether that involves going public remains to be seen, but the designer dropped some hints today.

Industry speculation about a Diane von Furstenberg IPO has been swirling for more than two years now, and the famed designer added some more fuel to the fire today.

When asked at a panel whether it's worth it for a high-end brand to be publicly-traded in today's era, von Furstenberg initially deflected the question, before noting the brand is contemplating how to translate itself for the future.

"Let me tell you something about our sponsor today — I made more money in the last 10 years with MasterCard than anything ever because I bought that stock when it was $40," she said to laughs (the stock closed at just over $83 on Monday). She then deferred to DVF Studio co-chair Joel Horowitz, who was speaking on a panel with her, and is famous for taking Tommy Hilfiger public in the 90s.

"I think it's like anything," Horowitz said at the event, which was sponsored by Financo, an investment bank that specializes in retail and consumer companies. "If you control expectations and you run your business the way the brand needs to be run for the long-term, not for the quarter, you can be very successful as a public company. The problem is we get pushed we get pushed we get pushed and sometimes you make the wrong decisions by being pushed by expectations. You have to go at your own pace."

Von Furstenberg, who is married to Barry Diller, chairman of IAC, the holding company that owns star online properties like Match.com and Tinder, said that the brand is working hard to figure out how to translate its past "into the future."

"I'm an old brand, a brand that is 40 years old, so the good thing about aging is that you have credibility," she said. "How do you live with the past and the history and translate it into the future? And that is the challenge and it is a very interesting challenge, and I'm very curious to see how we're going to do it."

She continued: "I think we get the vibes, and I think we are going to ride it in a very interesting way, and I welcome you all to watch us and to help us if you have any ideas, because it's been an interesting story. And I think it's not over, and hopefully I will leave something for my grandchildren. That's it."

NEW YORK CITY — The precipitous drop in arrests that had many wondering whether the New York City Police Department was engaging in a work slowdown may be coming to an end.

Speaking at a news conference Monday, Police Commissioner Bill Bratton said that the number of arrests made by NYPD officers was on the upswing, although he cautioned that the numbers had not yet returned to normal levels.

For the week ending Sunday, NYPD officers made 37% fewer arrests than they did during the same period last year, according to department statistics released Monday. But that was less of a drop than what was reported during the last week of 2014 and first week of 2015, when the NYPD made 61% fewer arrests compared with the same period a year earlier.

Perhaps most dramatically, the NYPD did not issue a single low-level summons on New Year's Eve, when more than a million revelers gathered in Times Square and at other city landmarks.

The drop in arrests began on Dec. 20, when two NYPD officers were shot and killed by a lone gunman from Baltimore.

Since the drop in arrests happened as several of the city's five police unions negotiated their collective contracts, and during a time when many rank-and-file officers were expressing their discontent with Mayor Bill de Blasio, many interpreted the situation as a work slowdown.

A work slowdown is a labor-organizing technique in which employees protest what they see as unfair working conditions by doing less of their job — an alternative to an all-out strike.

Pat Lynch, the president of the Patrolmen's Benevolent Association, the city's largest police union, has repeatedly denied that there was an organized labor action taking place.

Last week, Bratton said he wouldn't use the word "slowdown" to describe what was happening, adding that many factors could have influenced the drop in arrests.

But on Monday, he said that the NYPD had taken several "management actions" to ensure that police officers "went back to normal." He cautioned that those actions had not included denying officers vacation days.

Many of the NYPD's fiercest critics had welcomed the apparent slowdown as a break from what they call the department's over-policing of the city, which they say disproportionally affects lower-income and minority communities.

They were not pleased with the uptick in arrests.

UVA Reinstates Fraternity Accused In Rolling Stone Story

The reinstatement comes after a police investigation found no substantive evidence of the allegations in the story.

The University of Virginia reinstated a fraternity after a police investigation found no substantive evidence the allegations raised in a Rolling Stone article occurred.

"We welcome Phi Kappa Psi, and we look forward to working with all fraternities and sororities in enhancing and promoting a safe environment for all," UVA President Teresa Sullivan said in a statement on Monday, adding that the reinstatement is effective immediately.

In November, Rolling Stone published an article titled "Rape on Campus" and claimed a young woman named Jackie was raped by seven men at a fraternity house and that the university failed to respond to the assault. The article garnered so much attention that the university suspended all fraternities for the semester.

Two weeks later, following an investigation of the story by the Washington Post, Rolling Stone issued an apology to its readers.

The magazine's editor and publisher Jann Wenner said Columbia Journalism School will be conducing an independent review of Rolling Stone's editorial process.

"Rolling Stone has asked us to conduct an independent review of the reporting and editorial decision making that led to the publication of its recent story on sexual violence at the University of Virginia," Deans Steve Coll and Sheila Coronel, who will be leading the review, said in an email. "Rolling Stone has agreed to publish our report in its entirety, without editing, on its website, as well as substantial excerpts in the magazine."

Phi Kappa Psi has been at UVA since 1853 and has more than 800 alumni.

"We believe that in the midst of this ordeal, there is an opportunity to move forward with important safety improvements," Stephen Scipione, president of the Virginia Alpha Charter Phi Kappa Psi, said in a statement. "This has prompted us to take a closer look at ourselves and what role organizations like ours may play in the problem. It's opened all of our eyes to the problem of sexual assault. Now it's time to do something about it. As a fraternity, we are going to continue discussing the need in the coming weeks."

The website features nude photoshoots of various women combined with in-depth interviews, and will be updated with a new profile every week.
